Title: “When the Husband is Mild, the Wife is Gentle” 夫和妻柔: Arguments about Marriage in Tang Legal and Literary Judgments
Abstract: This talk examines some real and hypothetical cases from the Tang that deal with marriage disputes. These cases show how the formal law in the Tang (for example, the Tang Code) was often considered inadequate to deal with matters involving highly personal relationships. These cases also suggest that part of Tang “law”—understood broadly—was developed through using classical, historical, and literary allusions to articulate moral and equitable considerations. We will look at some of the arguments about marriage are that found in these cases, and ask why one would appeal to these arguments rather than to the Code or even to case precedents.
